Terms of Service

These terms govern your use of the cutkit background-removal service — the API at api.cutkit.ai, the console at console.cutkit.ai, the MCP server, and the SDKs (together, the "service") — operated by CUTKIT ai ("we"). By creating an account or using the service you agree to these terms. The service is intended for business and professional use.

1. The service

cutkit removes backgrounds from images you submit, via REST API, console, or MCP tools, and returns the result. We may improve or change the service; we will not materially reduce core functionality you have prepaid for without notice.

2. Accounts & API keys

You are responsible for your account and for keeping API keys secret. Keys are shown once and stored hashed; anything done with your keys counts as done by you. Revoke a key immediately in the console if you suspect it has leaked.

3. Credits & payment

• Pricing is flat $0.02 per image, every variant and option. New accounts get 15 free trial images, no card required.
• Credits are prepaid and non-expiring. The minimum top-up is $5; payment is processed by Stripe on their hosted checkout.
• You are charged per successful removal; a failed request is not billed (reservations reverse automatically), and an idempotent retry is never double-billed.
• Purchased credits are non-refundable except as required by law or as stated in section 8.

4. Acceptable use

You may only submit images you have the right to process, and you must not use the service to process or produce unlawful content — including, without limitation, content that sexualizes minors, infringes others' intellectual property or privacy, or is intended for deception or harassment. Automated use is what the service is for; abusive traffic patterns that degrade the service for others are not. We may suspend or terminate accounts that violate this section and will report content where the law requires it.

5. Your content

You retain all rights to your images and cutouts. You grant us the limited license needed to process them solely to provide the service — see the Privacy Policy for the image lifecycle (deletion within 24 hours, zero-retention tier, never used for training).

6. API license

We grant you a non-exclusive, non-transferable right to access the API and SDKs within the documented rate limits for your tier. You must not resell raw access to the service, misrepresent it as your own infrastructure, or attempt to disrupt or probe it beyond documented use.

7. Availability & disclaimers

The service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee uninterrupted availability; matting output quality varies with input material.

8. Termination

You may stop using the service and delete your account at any time. We may terminate for violation of these terms. If we discontinue the service or terminate your account without cause, we will refund your remaining prepaid balance.

9. Liability

To the extent permitted by law, our aggregate liability arising out of the service is limited to the amounts you paid us in the twelve months before the claim, and we are not liable for indirect or consequential damages, lost profits, or lost data. Nothing in these terms excludes liability that cannot be excluded by law (including for intent, gross negligence, or injury to life, body, or health).

10. Changes

We may update these terms; material changes are announced in the console or by email at least 14 days before they take effect. Continued use after the effective date is acceptance.

11. Governing law

These terms are governed by the law of the operator's place of establishment, to the extent permitted by law. Mandatory consumer protections of your country of residence remain unaffected.
